Housing is one of the most visible parts of H-2A, and one of the most inspected. Here is what the rules require (20 CFR 655.122(d)).
Who gets free housing
- Every H-2A worker.
- U.S. workers doing the same work who cannot reasonably return to their homes each day.
Housing must be free. You cannot charge rent, and you cannot charge deposits for bedding or other basics. A worker can only be charged for damage they caused beyond normal wear.
Which standards apply
- Housing you own or provide must meet either the federal OSHA standard for temporary labor camps or DOL's farmworker housing standards, depending on which applies to your housing.
- Rental or public housing, such as a motel or apartment, must meet local standards. Where there are none, state or federal standards apply.
Common items inspectors look at include sleeping space per person, beds, toilets and showers per number of workers, hot water, kitchen or meal facilities, heating, fire safety, and clean water.
The inspection timeline
- Your own housing is inspected and certified by your state workforce agency (or an agency acting for it). Plan for approval at least 30 days before your date of need.
- Rental housing needs a signed, dated statement to DOL saying it complies, with the number of beds and rooms, plus any local inspection report.
Book the inspection early. A late or failed inspection is one of the most common reasons a season slips.
If your housing falls through
If certified housing becomes unavailable for reasons outside your control, you must notify the state in writing right away, explain why, and show that the replacement housing complies.
Family housing
You must provide family housing if that is the normal practice in your area and job, and workers with families ask for it.
Keep these records
- the inspection report or certification
- the rental compliance statement, if you rent
- photos of the housing at move-in
- any notices to the state about changes
